Agreement to Terms

These Terms of Use constitute a legally binding agreement between you ("you") and Drivewise Solutions Limited ("Company," "we," "us," or "our") concerning your access to and use of the TheoryExam.co.uk website and related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with any of these terms, you are expressly prohibited from using the Service.

Intellectual Property Rights

This Service includes Driver and Vehicle Standards Agency (DVSA) revision questions. The DVSA has granted permission for the reproduction of Crown copyright material but does not accept responsibility for its accuracy.

Unless otherwise indicated, all source code, databases, functionality, software, website designs, text, images, audio, and video are proprietary to TheoryExam.co.uk or licensed to us and are protected by copyright laws. The questionnaires, questionnaires images, and hazard perception videos are licensed Crown copyright materials, and we have obtained permission to use them.

Limitations of Liability

TheoryExam.co.uk and its suppliers shall not be liable for any damages, including but not limited to:

  • Loss of data or profits
  • Business interruptions
  • Any other damages arising from the use or inability to use the materials on the website

This applies even if TheoryExam.co.uk or an authorized representative has been notified of the possibility of such damages.

Account Creation & Communications

By creating an account, including through social login (e.g., Google), you agree to receive updates and important information via email. You may unsubscribe at any time.

Prohibited Activities

You agree to use the Service lawfully and must not:

  • Engage in fraudulent or illegal activities
  • Disrupt or interfere with the Service or its servers
  • Copy, modify, distribute, or sell any part of the Service without our permission
  • Use the Service in a way that damages our reputation, unless for fair review purposes

User-Generated Content

Your submitted answers may be stored and used to enhance the learning experience. By submitting content, you grant TheoryExam.co.uk full ownership rights to use such answers in aggregated form for improving our learning system or sharing industry insights.

Links to Third-Party Websites

Our website may contain links to external websites. TheoryExam.co.uk is not responsible for the content of third-party sites, and accessing such sites is at your own risk.

Payments & Subscriptions

  • A paid subscription is required to access full features.
  • Payments are processed through PayPal.
  • Subscription details, including billing cycles, are provided on the pricing page and the checkout page at the time of payment.
  • Subscriptions will auto-renew and must be unsubscribed before renewal if continued access is not required.

Refunds & Cancellations

  • You can cancel your subscription anytime via your account panel.
  • Cancellation must be done at least 2 days before renewal to avoid being charged.
  • Refunds are not available once access is granted, due to the digital nature of the product.
  • If you cancel during a free trial but have completed limited theory questions or limited hazard perception clips.
  • If you cancel during the free trial without triggering the service fee, you will not be charged, and access will end immediately.

To ensure cancellation, verify your subscription status in your profile.

Modifications & Service Interruptions

We reserve the right to:

  • Modify or discontinue the Service at any time without notice
  • Change pricing, subscription content, or terms without prior notice
  • Conduct maintenance that may cause temporary downtime

We are not liable for interruptions due to software issues, technical maintenance, or unforeseen circumstances.

Governing Law

These Terms are governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Dispute Resolution

If you have a complaint or claim against us, you must:

  1. Contact us and allow reasonable time for resolution.
  2. If unresolved, submit a final legal action notice to info@theoryexam.co.uk and wait four weeks before initiating legal action.
